Madison, N.J., November 26, 2003 - Wyeth (NYSE:WYE) announced today that the jury returned a unanimous verdict in the Company's favor in the case of Linda Eichmiller vs. American Home Products, et al. The trial of this back-end opt out case had begun on November 6 before Judge Constance Russell in the Superior Court of Fulton County in Atlanta, Georgia. The plaintiff alleged heart valve injury from the use of the diet drug Pondimin.
“The jury's decision was amply supported by the evidence presented in this case,” says Peter Bleakley, an attorney representing Wyeth. “We proved that there was insufficient information to suggest an association between diet drugs and valvular heart disease when the plaintiff began using the product. Furthermore, we clearly showed that the plaintiff's medical condition was caused by a number of factors and could not be narrowed to her use of the diet drug, Pondimin. We also showed that surgery would not be required.”
Diet drugs will continue to be an issue that Wyeth will deal with aggressively, as the Company believes there are a significant number of cases that have no basis in law or fact.
